on making a charitable donation and receiving branded merchandise as a token of gratitude
1. General Provisions
1.1. This Public Offer (the “Offer”), in accordance with Article 641 of the Civil Code of Ukraine, is a proposal by the Civic Organization “THE COST OF FREEDOM”, legal entity identification code 45660480, located at: 8a Leonida Kadeniuka Ave., apt. 4, Kyiv, 02105, Ukraine, represented by the Head of the Organization Nazar Andriyovych Halych, acting on the basis of the Charter (the “Organization”), to an unlimited circle of legally capable individuals who voluntarily engage in charitable activity (the “Benefactor”), to enter into an agreement for a charitable donation on the terms set out in this Offer.
1.2. The Offer takes effect upon its publication on the Organization’s websites: https://costfreedom.com/ and https://shop.costfreedom.com/ (the “Website”). The Offer is open-ended and may be amended at any time by posting updated information on the Website.
1.3. Branded merchandise (merch) that a Benefactor may receive is solely a token of the Organization’s gratitude for a charitable donation made, and is not a “product” within the meaning of civil law. The transfer of branded merchandise does not constitute a sale and does not give rise to a purchase-and-sale relationship between the Parties.
2. Subject of the Agreement
2.1. The subject of this Agreement is the gratuitous and voluntary transfer by the Benefactor, into the ownership of the Organization, of funds (charitable donation) for the Organization’s statutory activities.
2.2. The amount of the charitable donation corresponds to the value indicated for the selected token of gratitude on the Website. The Benefactor independently and freely determines the amount.
2.3. As a token of gratitude for a charitable donation, the Organization may transfer to the Benefactor branded merchandise (a T-shirt or other merch). The type and description of the item are listed on the Website. Transfer is subject to availability and proper order placement.
2.4. The subject of this Agreement is not the direct or indirect receipt of profit by either Party. 100% of funds received as charitable donations are directed toward the Organization’s statutory activities.
3. Organization’s Activities
3.1. The Organization acts in accordance with its Charter: building and developing civil society, protecting citizens’ rights and interests, combating corruption, preserving historical memory, and promoting equality.
3.2. The Organization is non-profit and is listed in the Register of Non-Profit Organizations of the State Tax Service of Ukraine. Information about activities and financial reports is posted on the Website.
4. Making a Donation and Receiving a Token of Gratitude
4.1. The Benefactor independently determines the amount of the charitable donation by selecting the desired token of gratitude on the Website or entering a custom amount.
4.2. A charitable donation is made as a one-time payment via payment forms on the Website or by bank transfer to the Organization’s account.
4.3. To receive branded merchandise as a token of gratitude, the Benefactor provides when placing an order:
- recipient’s first and last name;
- contact phone number;
- city and Nova Poshta branch for delivery;
- preferred size and colour (if a choice is available).
4.4. The Organization is not liable for incorrect delivery details provided by the Benefactor. If delivery is impossible due to incorrect data, re-shipment is at the Benefactor’s expense.
4.5. Delivery of branded merchandise is carried out exclusively within Ukraine via Nova Poshta. Delivery costs are not included in the donation amount and are paid by the Benefactor upon receipt.
4.6. The estimated processing and dispatch time is 3 to 14 business days from donation confirmation. The Organization reserves the right to adjust dispatch timelines and will notify the Benefactor accordingly.
4.7. Branded merchandise received as a token of gratitude is not subject to return or exchange, except in cases of manufacturing defects. If a defect is found, the Benefactor contacts the Organization within 7 calendar days of receipt with photo evidence at info@costfreedom.com.
5. Charitable Donation and Its Use
5.1. A charitable donation is voluntary and, as a general rule, is non-refundable after it is made, as funds are immediately directed toward the Organization’s statutory activities.
5.2. Exceptions include technical errors or duplicate payments. In such cases, the Benefactor contacts the Organization at info@costfreedom.com within 3 business days. After verification, the Organization processes a refund in accordance with applicable law.
5.3. The Organization independently determines how to apply the charitable donation in accordance with its statutory activities. 100% of donations go toward the Organization’s work.
5.4. The Benefactor has the right to obtain information on the use of their donation through financial reports on the Website or by written request to the Organization.
6. Limitation of Liability
6.1. The Organization is not liable for:
- delivery delays caused by Nova Poshta or force majeure events (martial law, natural disasters, etc.);
- merchandise not meeting the Benefactor’s expectations, provided it matches the description on the Website;
- Website or payment service unavailability due to technical reasons beyond the Organization’s control;
- actions of third parties — payment systems, courier services, suppliers.
6.2. In the event of force majeure (martial law, state of emergency), the Organization’s obligation timelines are extended accordingly. The Organization will notify the Benefactor via the Website.
6.3. The Organization’s total liability to a Benefactor shall not exceed the amount of the charitable donation made.
7. Rights and Obligations of the Parties
7.1. The Organization undertakes to:
- use charitable donation funds strictly in accordance with the laws of Ukraine and solely within its statutory activities;
- transfer branded merchandise as a token of gratitude upon receipt of a charitable donation and proper order placement;
- ensure the safety and confidentiality of the Benefactor’s personal data;
- provide information about the use of donations.
7.2. The Benefactor undertakes to:
- provide accurate information when placing an order;
- pay for delivery upon receipt of the shipment;
- not misuse charitable mechanisms for unlawful gain.
7.3. By making a charitable donation, the Benefactor confirms their legal capacity, the voluntary nature of the transaction, and that the donated funds bear no encumbrances.
8. Acceptance
8.1. Acceptance of this Offer is the Benefactor’s transfer of funds via payment forms on the Website or to the Organization’s bank account. The moment of acceptance is the date the funds are credited.
8.2. Acceptance of the Offer constitutes the Benefactor’s full and unconditional agreement with all its provisions, including the understanding that the merchandise received is a token of gratitude and not a product within the meaning of consumer protection law.

9. Final Provisions
9.1. The relations between the Parties are governed by the laws of Ukraine.
9.2. All disputes shall be resolved through negotiation and, if that is not possible, through the courts in accordance with Ukrainian law.
9.3. The Organization reserves the right to unilaterally amend this Offer. Amendments take effect upon publication on the Website.
